>> president obama and the first family are back in washington tonight. after wrapping up their holiday vacation in hawaii. air force one touched down at joint base andrews in maryland earlier this morning. the president interrupted his vacation by flying back to washington to settle the fiscal cliff negotiations. now. he's back to face new battles over spending cuts and raising the country's

debt ceiling. the president could also announce nominees for key positions in his cabinet as soon as tomorrow. with the fiscal cliff beginning to fade from the minds of many americans a new fight is heating up on capitol hill. a new deal over the debt ceiling is looming in the not-so-distant future. we go now to elizabeth corridan to check up on both sides and how they're preparing to get a new deal in place. >> "i believe we need to raise the debt ceiling, but if we don't raise it without a plan to get out of debt, all of us should be fired." >> reporter: strong words for a new congress, the new years deadline for the so-called "fiscal cliff" has come and gone. now lawmakers start a new session under pressure to avert another financial crisis -- this time over raising the debt ceiling. if an agreement isn't reached by late february or early march, the united states risks defaulting on its financial obligations. the argument this time around will be over how much congress will agree to cut spending. >> "the bottom line is we can't continue down the path we're on of borrowing money

to pay our own debt with, and we've got to have serious spending cuts. we've got to have dollar for dollar within the same year." >> reporter: but key democrats say the debt limit and spending cuts are not related, and a deal based on a dollar-for-dollar offset could further damage the country's credit rating. >> "you're going to say i'm not going to pay my bills unless you stop buying stuff? then stop buying stuff so you don't have future bills. but right now we have to pay the bills that have been incurred. if you want to say cut spending for what we do next, fine. but don't tie it to the debt ceiling." >> "a big part of balancing this budget is in fact getting people back to work. that balances us twice, so that's another big piece of it." >> reporter: president obama has said he will not negotiate with congress on whether they should pay their bills. some republicans are now criticizing his fiscal leadership. >> "what's really disappointing to me is that the president isn't generating the discussion on his own, that he has to sort of be dragged kicking and scream, to the table when we have these other big issues like the debt ceiling to get him to talk about it. i wish

but the bulk of the rainfall is going to stay to the pacific northwest. showers near eureka here we are at midnight tonight with clear skies and the system is the rain and the clouds as we go for tomorrow look for the clouds to increase with mostly cloudy skies. as this weather system departs we will see clearing for the afternoon with temperatures in the 60s in some spots. 30's in the north bay. mid 30's for the east bay. loma 40's. and high is looking for a nice with mostly sunny conditions for the afternoon. mid upper 50s and nearly 60 degrees for the south bay. highs in the 50s for the east bay. concord.

>> coming up, we'll see why this coach who made a miraculous comeback after a tragic accident is now leaving in shame. a couple was killed late last night after a fire engulfed their massachusetts condominium. authorities say the victims are believed to be an elderly couple that lived in the woodcrest condominiums. the fire started in the

couple's fourth floor home and quickly moved through the building. four relatives staying with the couple were injured in the blaze but were able to escape with their lives. authorities are not releasing the names of the the cause of the fire is still under investigation. >> two women are on the loose today after escaping from the york correctional institute in niantic connecticut last night. authorities are searching for melissa riley and jessica rivera. it was on a walk back from the gym on saturday night that the guards first noticed the two were missing. they were being held in a minimum security section that is not completely fenced in. the two aren't considered dangerous but a reverse 911 call went out to warn the nearby residents of niantic about the incident. >> hall of fame track and field coach beverly kearney has retired from the university of texas. her resignation comes while the university investigates the allegations that kearney had a sexual relationship with a student athlete back in 2002. kearney is well known for her amazing recovery story after an auto accident left her partially paralyzed more than ten years ago. that crash killed two other people. kearney is also known for leading texas to six

new prices are too steep. tickets will be available for 380 dollars each. tickets opened at 240 dollars last year, with prices steadily rising as the event approached. organizers scrapped last year's lottery system and a first-come, first-served basis. the festival is held the week leading up to labor day in the nevada desert. >> as congress returns from their winter vacation so does the push from many legislators to put into place stricter gun laws. on day one there were nearly a dozen new bills introduced related to gun violence. for more we go now to athena jones in washington. >> reporter: as students at sandy hook elementary returned to class. former congresswoman gabrielle giffords -- nearly killed in a mass shooting two years ago -- visited newtown, connecticut. and on capitol hill, lawmakers arrived to begin a new session on congress. with members in both chambers taking aim at guns. > "this is a fight that the american people are going to

have to stand up and stiffen their spine." >> reporter: california democratic senator dianne feinstein plans to introduce a bill to ban more than a hundred assault weapons -- eight years after the old ban she championed expired. another senate bill would ban high-capacity magazines. and among nearly a dozen gun bills introduced on day one in the house are efforts to ban online sales of ammunition and to require background checks for all firearm sales, including at gun shows. two bills from freshmen republican congressmen -- would allow more guns around schools -- echoing the position of the national rifle association. a bad guy with a gun is a good guy with a gun." >> reporter: pro-gun control groups plan to keep pressing for action. but what are the prospects for their success? > "if you're talking about stuff around the edges, maybe banning high capacity ammunition magazines, that might be possible. the nra is the big issue, but i wouldn't say it's necessarily on the republican side only, it's on the democratic side

also. you have fully half of your new senate has either an a+, a or a- rating from the nra. so if you want anything to happen on gun control, you're going to have at least half of the senate upsetting the nra and that's a very difficult proposition." > "there is no more uphill fight than this. the question is, do we fight or do we knuckle under?" >> the man accused of shooting scores of movie- goers at an aurora colorado movie theater last summer is expected to face a judge on monday. the court will decide then if there is enough evidence to require james holmes to stand trial. casey wian has the details. >> aurora, colorado, just after midnight, july 20, 2012. >> 9-1-1 cal. 315 and 314 first shooting at century theaters, 14 300 east alameda avenue, they're saying somebody's shooting in the auditorium. >> he came down with his gun in my face.

he was about three feet away in that incident, i honestly didn't know what to do. i was terrified. >> (9-1-1 call). we need rescue inside the auditorium, multiple victims. >> the guy was just standing by the exit firing away. he's not aiming at a specific person. he's aiming everywhere, trying to hit as many people as he can. >> (9-1-1 call) i've got a child victim. i need rescue at the back door, theater nine, now. > i was thinking i just got to get out of the door, even if i fall dead, just get my kids out of here. >> it was just so horrible. >> (radio call)...suspect is going to be male, unknown race, black camo outside outfit believed to be wearing a vest, gas mask and multiple long guns. > you have the right to remain silent. >> reporter: that suspect, 25-year-old james holmes, is charged with killing 12 people and wounding dozens more. prosecutors are expected to call scores of witnesses before arapahoe county district judge william sylvester. he'll determine whether the evidence is sufficient for holmes to stand trial on more than 150 counts, including murder, attempted

murder and weapons charges. the weapons included explosives allegedly used to booby-trap holmes' apartment. his attorneys are expected to present a diminished mental capacity defense. > the government's going to absolutely say that. > the government's going to say this guy wasn't crazy. > he was crazy like a fox. > he was conniving. > he was premeditated. he was methodical and that all may be true, but at the same time you can also have a mental disease or defect. >> reporter: he had been seeing a psychiatrist at the university of colorado, where he was a doctoral candidate in neuroscience until dropping out in june. his attorneys say he was hospitalized in november after repeatedly banging his head into a jail wall. the preliminary hearing is expected to last several days. the judge has issued a sweeping gag order, so this may be the first time the public hears much of the evidence against holmes. casey wian, cnn, los

angeles. >> president obama has signed a financial aid package for president barack obama is expected to nominate republican chuck hagel as the countries newest defense secretary tomorrow. that's according to a senior administration official. the former senator and decorated vietnam war veteran is going to replace the retiring leon panetta. obama and hagel built a strong relationship during their time together in the u-s senate. over the next couple of weeks both obama and hagel will likely face a lot of questions on where hagel stands on many key issues as the country transitions into the future. >> president obama has signed a financial aid package. the congressional package for more funds will face tough scrutiny as it looks for more spending and debt. the bay area saw it's own days of damage after some brutal storms. this is video from our kron archive from more than 30

>> police are searching for a suspect after a taxi cab driver was stabbed outside of the macarthur bart station last night. police say that around 6:45 p-m a man got into a taxi cab outside the bart station on 40th street. the suspect and driver then got into an argument which ended when the suspect stabbed the driver. the man then fled the scene on foot and the cab driver was taken to the hospital. as of this morning the victim is in stable
